Terms of Service

Welcome to havstock.com, operated by Havstock FZ-LLC, a free zone limited liability company registered in Ras Al Khaimah, United Arab Emirates ("Havstock", "we", "our" or "us").

By accessing or using our website, products, services or any related content (together, the "Services"), you agree to these Terms of Service ("Terms") and to our Refund Policy and Privacy Policy, which form part of these Terms. Please read them carefully. If you do not agree with these Terms, do not use our website or Services.

1. Overview

Havstock provides a monthly marketing subscription (Havstock Unlimited), digital products, community membership and consulting services to businesses. These Terms govern your use of our website and any products, services or information provided through it.

2. Use of Our Services

By using our Services, you confirm that you are at least 18 years old, legally able to enter into this agreement, and buying for business purposes.

You agree to use our Services only for lawful purposes and in line with all applicable laws and regulations. You may not use our Services to distribute malware, spam, or any content that infringes another party's rights.

3. Havstock Unlimited (Marketing Subscription)

3.1 What it is

Havstock Unlimited is a monthly subscription under which our team provides marketing services for your business. Depending on your needs, this can include ad management and ad creatives, websites, landing pages and funnels, email marketing and follow-up, SEO and AEO, an AI chat widget, CRM setup and automations, and a monthly results report. The scope of work in any month is set by the requests you make.

3.2 One plan per business

Each subscription covers one business, including its website, funnels, ad accounts and CRM. A second business, brand or client needs its own subscription.

3.4 Billing, renewal and price

The subscription is billed monthly in advance through Stripe and renews automatically each month until you cancel. The price is the price shown at checkout, including any discount code applied there. If you joined with a discount, that price stays the same for as long as your subscription stays active. It does not carry over if you cancel and rejoin. We may change our standard price for new customers at any time. We will give existing subscribers at least 30 days' notice before any change to their price.

3.5 Cancelling

You can cancel at any time in your Stripe billing portal at billing.stripe.com (log in with the email you joined with), or by emailing support@havstock.com. Cancelling takes effect at the end of the month you have already paid for, and you will not be charged again. We do not pause subscriptions. If you cancel and later rejoin, the price at the time you rejoin applies. Refunds, including the 75% first-week refund, are covered in our Refund Policy.

3.6 Ad spend and ad accounts

You pay advertising platforms (such as Meta, Google and LinkedIn) directly for ad spend. Our subscription fee covers running your ads and creating your ad creatives, not the ad spend itself. Ad accounts are set up in your name or connected to accounts you own, and stay yours.

3.7 CRM and software

Unless we agree otherwise, your CRM, email, SMS, booking and AI chat tools run on a sub-account of our GoHighLevel agency account, at no extra software cost to you. This includes a fair-use allowance for usage-based costs (such as emails, SMS, phone and AI). Usage above that allowance is billed to you at cost, and we will tell you before this happens. If you cancel, we will help you export your contacts and data, or transfer the sub-account to your own GoHighLevel account, within 30 days of cancellation.

3.8 What is not included

Unless agreed in writing: filming or photo shoots, full custom software builds, print design, organic social media posting and community management, logo and full brand identity work, ad spend, and third-party software or services bought in your name.

3.9 Your responsibilities

You agree to give us the access, information and approvals we need to do the work, to make sure your offers, claims and ads are truthful and lawful, and to follow the policies of the platforms we use on your behalf. You are responsible for the products and services you sell and for the accuracy of anything you ask us to publish.

3.10 Who owns the work

Once paid for, the work we create specifically for your business (such as your website, pages, funnels, emails, ad creatives and copy) belongs to you, and you can keep using it after you cancel. Our own templates, frameworks, internal tools, code libraries and know-how remain ours. Where they form part of your work, you get a permanent licence to use them for your business.

4. Intellectual Property and Product Licence

All content, designs, graphics, code, text and materials on havstock.com are owned by or licensed to Havstock and are protected by copyright, trademark and other intellectual property laws.

Digital products are licensed, not sold. Your purchase gives you a non-exclusive, non-transferable licence to use the product for your own business (or, where the product expressly allows it, for your clients' projects). You may not copy, resell, redistribute, share, publish, sublicense, or use any digital product to create a competing product. This licence applies equally to current products and to discontinued products you keep access to.

5. Products and Payments

All prices and fees are listed or quoted in USD. Payments are processed by third-party payment providers, including Stripe.

5.1 Digital products, templates, snapshots and one-click upsells or downsells

Digital products, including downloadable templates, files and ZIP archives, GoHighLevel snapshots and automations, AI skill files, order bumps, one-click upsells and downsells, courses and training materials, are delivered immediately upon purchase. Where a one-click upsell or downsell is offered after checkout, the price is shown before you confirm, and confirming charges your payment method immediately as a separate transaction.

All digital product sales are final. Refunds are governed only by our Refund Policy, which includes any product-specific guarantee advertised on a product's sales page and a conditional money-back review requiring evidence of implementation. Refund decisions outside an advertised guarantee are made at our sole discretion.

5.2 Payment plans and instalments

Some products are offered on a payment plan: an initial payment followed by one or more scheduled instalments. A payment plan is a way of paying for a single purchase over time. It is not a subscription, not a trial and not a discount, and it does not change the price of the product.

By choosing a payment plan at checkout you authorise us and our payment processors to charge each scheduled payment on the dates shown to you at checkout, using the payment method you provide. You remain responsible for the full purchase price. Cancelling the plan, removing the payment method, disputing a payment or no longer using the product does not cancel your purchase or end your obligation to complete the plan. If a scheduled payment is cancelled, fails or is disputed, we may suspend or remove your access immediately, and the remaining balance becomes payable in full. We may decline to offer a payment plan to any customer and may require payment in full.

5.3 Community membership and free trial

Our Consulting community is hosted and billed through Skool.com. New members get a 7-day free trial. Unless cancelled before the trial ends, billing starts automatically at the advertised monthly price and repeats monthly until cancelled. You can cancel at any time through your Skool account, which stops future billing. Amounts already billed are not refunded. Skool's own terms and policies also apply.

5.4 One-off done-for-you builds and consulting

For one-off builds and consulting agreed outside Havstock Unlimited, payment is required upfront unless otherwise stated in writing. Because these services involve custom work and strategy, they are final and non-refundable once work has started.

5.5 Discontinued products

Products we no longer sell remain available to their original buyers on an as-is basis under the licence they were bought with. We may retire hosted or platform-dependent parts of discontinued products with reasonable notice where practical.

If you have a payment issue or dispute, contact us at support@havstock.com before contacting your bank, and we will review your case individually.

6. Results Disclaimer

We make no guarantee of specific financial or performance results from using our products or services, including Havstock Unlimited. Results depend on many factors outside our control, such as your offer, pricing, audience, ad budget, market conditions and how quickly you act on leads. Figures shown on our website, including example dashboards and mockups, are illustrations. Testimonials reflect individual experiences and are not a promise of similar results. You acknowledge that Havstock is not responsible for your business performance, sales or profitability.

7. Third-Party Tools and Integrations

Our products and services may integrate with or depend on third-party platforms (for example GoHighLevel, Stripe, Skool, Meta, Google, LinkedIn, Anthropic's Claude and other AI providers, and email providers). We are not responsible for how those platforms operate, perform, price their services or handle data, and features that depend on a third-party platform may change if that platform changes. Ad account restrictions or rejections by a platform are outside our control. By using our Services, you also agree to follow the terms and policies of those third parties.

8. Limitation of Liability

To the fullest extent permitted by law, Havstock and its team are not liable for any indirect, incidental or consequential damages arising from your use of (or inability to use) our website, products or services. Our total liability under these Terms will not exceed the amount you paid us for the specific product or service in question, or, for Havstock Unlimited, the fees you paid in the three months before the claim arose.

9. Indemnification

You agree to indemnify and hold harmless Havstock, its affiliates and its team from any claims, damages or losses arising from your misuse of our Services, your breach of these Terms, the content, offers or claims you ask us to publish, or your infringement of any third party's rights.

10. Termination

We may suspend or end your access to our Services at any time if we reasonably believe you have breached these Terms (including the product licence in Section 4), filed a payment dispute in bad faith, asked us to publish unlawful or misleading content, or acted unlawfully. If we end a Havstock Unlimited subscription without cause, we will refund the unused part of your current paid month.

11. Your Statutory Rights

Nothing in these Terms excludes, restricts or changes any consumer right or guarantee under applicable law that cannot lawfully be excluded, including under the Australian Consumer Law, the UK Consumer Rights Act 2015, or European Union consumer protection law. Where such rights apply, our liability is limited only to the extent that law allows.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. Subject to Section 11, any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, United Arab Emirates.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, with the updated date shown at the top. By continuing to use our Services after an update, you agree to the revised Terms.
